Public Announcement No. 2019-23 by the Ministry of Food and Drug Safety Standard for Reviewing Food Labeling or Advertising and Filing Objections to Review Results March 22, 2019 1. Reason of Establishment This Standard is established to prescribe matters associated with (1) reviews, including the method of requesting a review, review procedures, and processing of review results, when the Minister of Food and Drug Safety performs a review because of the absence of the voluntary review board assigned as in the proviso under Article 10.1 of the Act on Labeling and Advertising of Foods and Article 4.3 of the Enforcement Decree of the same Act and (2) objections to the review results, including the method of filing an objection, review procedures, and processing of review results, if a person has an objection to the results of the review that has been assigned as in the proviso under Article 10.4 of the same Act and Article 6.3 of the Enforcement Decree of the same Act. 2. Main Contents A. Requesting a Review, Reviewing, and Processing of Review Results (Articles 2 and 3 of the Draft) 1) A person who seeks a review of the labeling or advertising shall submit a Request for Review together with the required documents to the Minister of Food and Drug Safety. 2) Reviewing standards and procedures are established, and review results are to be notified to the competent authority having jurisdiction over the Requester’s business location, which deals with business licenses or reporting. 3) Some of the deletion or modification, which do not alter the contents reviewed, are not subject to a review on changes. B. Filing an Objection (Article 4 of the Draft) 1) Documents required when filing an objection as in the proviso under Article 10.4 of the Act are specified. 2) The reviewing standards for filed objections shall follow the provisions under Article 4.1 of the Enforcement Decree of the Act. 3) Specific details on the deliberation and handling of review results are set. C. Advisory Committee (Article 5 of the Draft) 1) An advisory committee may advise on the reviewing or objections.
